Unwritten constitution
-This is a constitution where the fundamental principles of the organization and powers of the government are not contained in one document but rather in several scattered documents to add to the customs of a country.
-For example, the British constitution.
Sources of British constitution.
a) Statutes. This refers to an Act of Parliament.
b) Customs. This refers to ancient or traditional practices or the common law. For example, the first born inheriting the throne.
c) Laws of precedents. Past accepted principles may be applied to a new set of facts in a judgment.
d) Customs of parliament.
House procedures including standing orders and other
regulations are part of the British constitution.
e) Historical documents. Such as the:
- The Magna Carta (1215AD)
- The Petition of Right (1628)
